Dicamba Herbicide Update – EPA Issues Existing Stocks Order

This is a follow-up to the February 6, 2024 court ruling where Xtendimax, Engenia, and Tavium herbicide labels were vacated by a federal court in Arizona. The Arizona court order prohibits sale or distribution of these three dicamba products after February 6, 2024. On February 14, 2024, the EPA issued an existing stocks order for these dicamba products registered for over-the-top applications in dicamba-tolerant cotton and soybean. This order notifies the registrants of Xtendimax, Engenia, and Tavium guidelines for the disposition of any existing stocks of these products that were released for shipping prior to the February 6, 2024 ruling. Existing stocks are the previously registered products that were packaged, labeled, and released for shipment before the date of the court ruling. For South Carolina, these are the sale/distribution and use end dates for Xtendimax, Engenia, and Tavium herbicides for the 2024 growing season:

With this order, growers are encouraged to reach out to retailers and secure their dicamba product orders as soon as possible. After the end of this existing stock order, these dicamba products will be unavailable until the court ruling is appealed/overturned or new dicamba product labels are registered before the 2025 growing season.
